Overview
Arizona has legalized recreational marijuana for adults 21 and over since 2020. This legalization extends to Delta 9 THC products derived from marijuana plants. The state also permits the cultivation, production, and sale of hemp and hemp-derived products like CBD, provided they contain less than 0.3% Delta 9 THC by dry weight, in line with federal regulations.
Regarding other cannabinoids, the Arizona Attorney General recently issued an opinion stating that delta-8 THC, delta-10, and other hemp-derived intoxicating substances can only be sold by businesses licensed to sell cannabis products. This effectively bans the sale of delta-8 and similar compounds at unlicensed retailers like smoke shops. However, CBD and other non-intoxicating hemp derivatives like THCA remain legal for general retail sale if they meet the federal THC limit. The opinion does not impact the legality of marijuana-derived Delta 9 THC products from licensed dispensaries.
